1, Robert Gordon Shewan, of Victoria Hongkong,

Merchant, do solemnly and sincerely declare that:-

1. I am a member of the firm of Shewan, Tomes & Co. of Hongkong, Canton and Shanghai, London and New York.

2. In the month of January, 1905, the Manager of the National Bank of China, Limited, enquired if my said firm who act as agents for the Bank in Canton would take possession of a quantity of over 40,000 tons of coal stored at kati Canton against which the National Bank had been asked to make an advance. I was informed that the Bank would only make an advance upon the condi- -tion that my firm took possession of the coal and held same on behalf of the Bank. I agreed to take possession of the coal and that no coal should be taken away or disposed of except under delivery orders signed by the Bank.

3. After the Mortgage was executed in favour of the Bank instructions were given to my Canton House to take possession of the coal and to notify the British Consul-General that the coal

was pledged to the National Bank of China Limited.

4. After such possession was taken no deliveries were made of the coal except under delivery orders given to my said firm by the Bank.

And make this solemn Declaration conscientiously believing the same to be true and by virtue of the provisions of

the Statutory Declarations Act,

Declared at Victoria in Hongkong this 26th. day of February, 1906.
